Agenda Title:

Approve Transfer of Property Jointly Owned with Pennington County to Sole City Ownership and Authorize Staff to Accept and Record Deed(s)

Summary:

The Pennington County Board of Commissioners on February 2, 2016 voted to request that the City of Rapid City accept transfer of 132 properties jointly owned by the County and the City to 100% City ownership. A majority of these parcels are currently maintained by the City and located in areas known as Rushmore Lions Nature Park, Cliffside Park and Braeburn Dog Park.  All parcels are identified within the Floodplain Development Policy Committee Final Report and A Resolution Establishing A Rapid Creek Floodplain Policy adopted July 7, 2008 that outlines, “The City Council shall adopt a resolution dedicating as park land the publicly owned property listed on Exhibit A, List of Public Land to be Designated Park Land as shown on Exhibit B, Maps of Public Land to be Designated Park Land.”  If you approve this request, the County will surplus and approve deeding the property to the City.  The transfer will be made at no cost to the City. 

Funding Source & Fiscal Impact (if applicable):

Fiscal impact should be minimal.  There is no cost to acquire the properties.  Parks and Rec has been maintaining the properties since acquisition, and there is no record (at least in the recent past) of Pennington County participating in upkeep/mowing/etc.
